To mediate or not to mediate my construction dispute - what are the questions?

Do you have a construction dispute? If you do, the first thing you need to decide is whether it should be mediated.

DAVID CORNES,  BSc(Eng), AKC, FICE, FCIArb, SOLICITOR

David is a full-time independent commercial mediator. He was accredited by the Centre for Effective Dispute Resolution (CEDR) in London in 1993. Until the end of 2004, he was Senior Partner of Winward Fearon, Solicitors, with very extensive experience of commercial negotiation and disputes. He mostly takes mediation referrals directly but is on several mediation panels, including The Panel of Independent Mediators (PIM), the Mediation Panel of the Court of Appeal in London, The Mediator Panel of the Chartered Institute of Arbitrators and the CPR Construction and International Panel (International Institute for Conflict Prevention & Resolution, New York )”

ROWAN PLANTEROSE, HEAD OF THE CONSTRUCTION GROUP, DAVIES ARNOLD COOPER

Rowan is a solicitor, formerly a practising barrister.  The majority of Rowan's work is for substantial contractors or their professional advisers. Rowan specialises in complex construction and engineering disputes, including associated professional negligence actions, whether in litigation (Technology and Contruction Court ), arbitration or adjudication.  His work within the engineering field includes structural, civil (including road building and tunnelling), mechanical and electrical, power generation, hazardous waste disposal, oil and chemicals, food processing, railways, telecommunications, off-shore and on-shore drilling.

Rowan is a Chartered Arbitrator, co-author of  a book on the 1996 Arbitration Act, and author of the adjudication section of Bernstein's Handbook of Dispute Resolution.

 

TIM GULLIVER, PRACTICE DEVELOPMENT LAWYER - DAVIES ARNOLD COOPER 

Tim is the Practice Development Lawyer for the Construction and Energy Group at Davies Arnold Cooper. He is responsible for the Group’s technical training and know how. He has worked in the field of construction law for some 20 years and has had wide experience of dispute resolution and contract drafting. He has acted for employers and contractors in private practice and has worked in-house for one of the country’s largest construction firms. He has also been a CEDR accredited mediator and has acted as lead mediator in a number of construction disputes.
