ODA PROCUREMENT MUST ADHERE TO EU REGULATIONS

Contractors across the UK should not expect to receive special treatment in light of existing EU directives which say that contracting authorities must not discriminate in favour of the home team. The award of Olympic contracts is subject to the principles of equal treatment meaning that any form of 'Buy British' strategy would be contrary to EU law. However, UK contractors should not be too put out because selection will be based on factors such as reliability, financial and economic standing and technical and professional capacity which could mean that UK based companies find themselves leading the race.

The ODA recently announced details of its key delivery partner contract. It is the first major contract of 2006 and according to David Higgins, Chief Executive of the ODA critical to the overall success of the project.

The contract deals with the planning, design, construction, commissioning and maintenance of Olympic venues and park. It will focus on rewarding performance and management of risk as opposed to penalising failure.

Companies with a turnover of £100m, or consortia where each member has a turnover of £50m, are eligible to apply. They need to register by 25 April 2006 to participate.

A high profile business summit was held at the end of January to inform businesses how they can benefit from the 2012 Olympic and Paralympic Games.

Several of the keynote speeches focused on the building of the Olympic infrastructure with David Higgins of the ODA and Peter Rogers, Chairman of the Strategic Forum for Construction, commenting on how the construction industry can benefit from the Games. Full details of each speech can be found
here. A regional summit will be held in July.

The Strategic Forum's Olympic Task Group is expected shortly to publish details of construction commitments to which all construction industry participants will be expected (at least informally) to subscribe.
