Supreme Court judgment O'Byrne v Aventis Pasteur SA - Wire

This case is the concluding chapter in a piece of litigation which began in 2001 when the claimant first issued proceedings. Now, following no less than two visits to the European Court of Justice (2006 and 2009), one to each of the High Court (2003), Court of Appeal (2007) and House of Lords (2008), judgment has been delivered by the new Supreme Court. The progress of this case has been charted in a number of earlier Wires.

Claims control - giving it all away - Wire

If an insurer has exercised its right to control the defence of a third party liability claim, or if a liability policy expressly enables an insurer to control all proceedings in respect of claims for which it might be liable, the insured is prohibited from settling any claims without the consent of the insurer. Such prohibition also extends to claims brought by the insured against third parties that impact on rights of indemnification. This issue was recently considered in the case of Clare Horwood & Others v Land of Leather (in administration) and Zurich Insurance Plc and Others.

Farraj v King's Healthcare NHS Trust - Wire

In this recent wrongful birth case, where judgment was handed down by the Court of Appeal on the 13 November 2009, an NHS Trust successfully appealed against a finding of liability. The claim had been brought by the parents of a child who contracted an inherited blood disorder from his parents, both of whom were carriers of the gene that caused the disorder.

The Jackson Report: Proposals for Collective Actions - Wire

Lord Justice Jackson's long-awaited final report was published on 14 January 2010. The report follows on from the wide-ranging proposals set out in his preliminary report published in May 2009. Weighing in at well over 500 pages, there is a lot to digest, with the report containing recommendations which, if accepted, would herald a huge shift in the litigating of civil claims, both large and small.

The long and winding road - Product Liability wire

This is the latest instalment in a long-running claim which was first issued in November 2000. On 2 December 2009, the European Court of Justice (ECJ) delivered its second ruling in the case of O'Byrne v Aventis Pasteur MSD Limited in response to questions raised by our national courts. We previously discussed the case in Wires dated July 2005 and February 2006.
