Since publishing its guidance ("Guidance") on the relationship between the Environmental Information Regulations 2004 ("EIR"), the Freedom of Information Act 2004 ("FOIA") and the Local Authorities (Charges for Property Searches) Regulations 2008 ("the Charging Regulations") on the 16 July 2009 which stated that the majority of information provided by local authorities in response to property search enquiries is environmental, the Information Commissioner's Office ("ICO") have published two decisions notices on this issue. Both decisions reinforce the ICO's Guidance and will cause concerns for local authorities worried about the impact that the Guidance will have on their income raised by charging for property search services.
