Construction mediation & alternative dispute resolution

Mediation is the most common form of alternative dispute resolution in the construction industry.

 It involves the participation of a professional mediator to assist parties in dispute to reach a settlement. Mediation has become increasingly common in the international and domestic construction industries as parties become dissatisfied with the cost, delay and the uncertainty of litigation and arbitration. It is a useful and flexible technique in both simple and the complicated disputes. 

We advise clients on the best route to promote conflict avoidance, particularly in relation to high-value, complex and international disputes. 

In relation to international and domestic mediations, we advise on preliminary advice and assistance and setting up the mediation. We advise on the logistical and administrative arrangements when agreeing terms of the Mediation Agreement. We draft and exchange case summaries and documents and identify and appoint an appropriate Mediator. We can also provide a venue for the mediation and represent clients at the mediation itself.

We act as mediators as and when required.
