The Court of Appeal judgment in Tyco v Rolls Royce, handed down in April 2008, highlights the importance of precise wording in construction contracts containing a provision for joint names insurance. Further, it calls into question whether the existence of a joint names insurance policy overrides a contractor's liability to an employer for damage caused by the contractor's negligence.

February 8th 2008 - Support for a good cause - Insurance update
In Drake v Harbour [2008] EWCA Civ 25 the Court of Appeal upheld a decision that the judge had been entitled to find that the negligence of an electrician in failing properly to inspect a festoon cable was the cause of a fire even though the claimant had been unable to establish the exact mechanism that had led the cable to overheat.  The prospects of success for insurers pursuing subrogated recoveries are as a result improved - claimants will succeed if they can establish a credible (albeit not precise) cause in the absence of any other reasonable explanations for the loss.
