The insurance and civil liability division is made up of a team of lawyers with extensive experience in the management and defence of civil liability cases, as well as recovery actions undertaken for insurance companies. With the agreement of the client, we always try to settle issues out of court and to avoid unnecessary and costly litigation.
We have extensive experience in drafting and adapting insurance policies, as well as representing insurers and reinsurers before the Dirección General de Seguros (Spanish insurance regulator), statutory audits, mediation between insurers and national or international arbitration in insurance and reinsurance.
Davies Arnold Cooper also acts as tax representative for a significant number of national and overseas insurers.

- Incorporation of insurance companies, resolution of regulatory and tax issues, audit and due diligence processes and tax representations.
- Professional civil liability: We have been involved in practically all of the significant liability cases involving directors and officers (D&O) in the last 15 years. We have extensive experience in cases of alleged medical malpractice, health-centre liability and responsibility for clinical trials. We have also defended numerous cases involving the liability of architects and technical architects, engineers, lawyers, solicitors, insurance brokers and other professionals. We also advise on BBB, especially in financial entities.
- Industrial risk: We have directed the defence in important claims against construction companies and engineering firms, as well as manufacturers and importers in a wide range of sectors including automotive, food, pharmaceutical, technology and explosives. We have also been involved in numerous environmental claims and provided advice in land decontamination, waste disposal, asbestos risk, and technology risks. We carefully defend power companies in civil-liability and supply-outage claims, as well as shipping and freight firms.
- Injury and other personal damage: We have been involved in numerous cases involving mass infection, salmonella and other food poisoning cases, as well as serious road traffic accidents.
