We have advised clients, including companies and insurers, on asbestos liability-related issues for over 30 years. A new risk is that prosecutions for breach of the control of Asbestos at Work Regulations 2002 are increasingly likely.
How can we help
The Asbestos at Work Regulations 2002 have imposed a tight timetable for inspecting all non-domestic premises. New asbestos liabilities are created by these regulations including, for the first time, a duty to manage asbestos in premises. Breach of the regulations is a criminal offence, punishable in the Crown Court by an unlimited fine or maybe even imprisonment. The regulations may also create additional civil liabilities. Our health and safety lawyers have market-leading experience of dealing with prosecutions. We also act on behalf of insurers and re-insurers facing "long tail" claims.
What we've done
Recent high profile cases include the Boots gas mask litigation, Cape plc South African litigation and litigation in shipyards and power stations in the UK. In addition to defending companies in these complex claims, our asbestos liability lawyers also provide advice on policy issues and recoveries. We have recently lobbied Government on behalf of clients concerned about the impact of new legislation and the high cost of liability insurance.
