Why come to us:
Davies Arnold Cooper has a specialist team of hotels lawyers advising on transactions in the UK and Spain, including the sale and purchase of hotels and hotel businesses, new hotel developments, funding, hotel leases and management contracts. Our clients include purchasers and investors, developers, banks and funders, and operators.
The group also has a specialist travel litigation team advising hotels on compensation claims brought against them. We provide practical guidance on this complex area of litigation to avoid the negative PR and brand damage that can result from such claims.
How we can help:
Our hotels team draws on a range of expertise from different parts of the firm. We are able to field experienced individuals with expertise in the key fields of real estate, corporate and M&A, banking and finance, employment, construction, planning, environmental and litigation.
In addition to the development, finance and construction aspects of these transactions we also advise on future operational issues for hotel businesses, whether to be run through a leasing structure (involving a fixed or turnover based rent) or through separating out the operational side of the business from the ownership of the underlying property asset by way of a management contract. Our hotels lawyers also act regularly for banks and other financial institutions lending to the hotels sector.
What we've done:
The team has recently received several high value instructions including one involving both Madrid and London on a new development to be let on a management contract to a high-profile hotel operator.
We advised H10 Hotels, a major Spanish operator on a £10m acquisition for a four-star, 200-bedroom hotel in Waterloo Road, London SE1.
We advised I/S EjendomsInvest on the acquisition of six Park Inn Hotels from Jefferson Hotels Limited Liability Partnership in a deal worth £95m.
We acted for City Road Investments Limited, a newly formed company, in connection with developing the Grade II Listed Lowndes House on City Road London EC1 as a 395 bedroom Travel lodge. Subsequently we acted for the company on financing the development.
We acted for Jersey Waterfront Hotel Holding Limited in relation to its new 195 bedroom international four star hotel and conference centre development on the St Helier Waterfront.
Travel litigation
We defended a hotel in proceedings brought by a tour operator relating to mass food poisoning. The incident involved a number of infants. By drawing on our experience in infant claims and in-depth knowledge of Spanish law through our Madrid office, we achieved a favourable settlement for the hotel's insurer.
