Product safety

Why come to us

Building on our experience as the leading product liability defence practice in the UK, we also advise on product safety.  Ensuring consumer safety is governed by a regulatory regime and is enforced by the state.

How we can help

Our prodect safety lawyers can assist manufacturers achieve compliance with product safety regulations while also helping them to reduce exposure to potential product liability claims.  Manufacturers are currently awaiting the transposition of the revised General Product Safety Directive into UK Law.  The directive imposes a general safety requirement that consumer products placed on the market must be safe and that consumers must have the information needed to assess risks associated with products.  We can assist with interpretation of the directive, safety issues, labelling requirements and, if necessary, product recall.

The revised GPSD also introduces the precautionary principle, which applies where preliminary scientific evaluation indicates there are reasonable grounds for concern that the product poses risks to the safety of consumers. The application of this principle will require careful and reasoned assessment of a product's safety and has potentially far-reaching implications for manufacturers of new and cutting edge technology.

What we've done

As this area of the law has developed over the last decade, our product safety lawyers have advised companies in a wide range of industry sectors on how to manage their compliance with safety regulations, their communications with their customers and their submissions to both Government bodies and the press.
