Guy is an experienced litigator with particular expertise in disputes relating to land, including: landlord and tenant, nuisance, trespass, prescriptive rights, rights of way and restrictive covenants. He has considerable experience in the obtaining of vacant possession for redevelopment purposes and in relation to removing impediments to development generally.
Guy has been involved in several significant cases including Crest Residential (South) Limited v McAllister in the Court of Appeal which clarified the law on the annexation of the benefit of Restrictive Covenants and David Wilson Homes Limited v Martin again in the Court of Appeal also upon the application of Restrictive Covenants. He was also a member of the Crown's legal team in Aberdeen Steak Houses v Crown Estate Commissioners, a leading case on the effectiveness of break notices, and acted for Swiss bank Sogenal in United Bank of Kuwait v Sahib, an important case on the validity of charges on land created by deposit of title deeds.
He has also recently successfully defended proceedings brought by a retail tenant in the high-end women's fashion trade for losses in excess of £600,000 against its landlord for damages arising from a leak in pipe work serving the premises.
